§ 1. General provisions

  1. These Terms and Conditions set out the rules for using the Bunkier online shop, including:
    1. the rules for using the Shop website,
    2. the rules for providing services electronically,
    3. the rules for placing orders,
    4. the rules for concluding sales contracts,
    5. the rules for payments and delivery,
    6. the rules for withdrawing from a contract,
    7. the rules for submitting and handling complaints.
  2. The owner of the Shop and the Seller is:

  1. These Terms and Conditions are made available free of charge on the Shop website in a manner that enables the Customer to obtain, reproduce and retain them.
  2. The Customer must use the Shop in accordance with applicable law, these Terms and Conditions and accepted standards of conduct.
  3. Matters not governed by these Terms and Conditions are subject to Polish law, in particular:
    1. the Polish Civil Code,
    2. the Polish Consumer Rights Act,
    3. the Polish Act on the Provision of Electronic Services,
    4. other applicable generally binding laws.
  4. Provisions of these Terms and Conditions relating to Consumers also apply to an Entrepreneur entitled to consumer protection to the extent required by applicable law.

§ 2. Definitions

For the purposes of these Terms and Conditions, the following terms have the meanings set out below:

  1. Shop – the online shop operated at sklep-bunkier.pl.
  2. Seller – the entity identified in § 1(2) of these Terms and Conditions.
  3. Customer – a natural person, legal person or organisational unit without legal personality that uses the Shop or concludes a contract with the Seller.
  4. Consumer – a natural person who enters into a legal transaction with the Seller that is not directly connected with that person's trade, business or profession.
  5. Entrepreneur entitled to consumer protection – a natural person who concludes a contract with the Seller directly connected with that person's business activity where the contract is not of a professional nature for that person, having regard in particular to the subject of their business activity.
  6. Customer Account – the Customer's individual panel in the Shop, where this functionality is provided by the Seller.
  7. Sales Contract – a contract for the sale of Goods concluded between the Customer and the Seller through the Shop.
  8. Goods – movable items or products offered for online sale in the Shop and forming the subject of a Sales Contract. Firearms displayed in the Shop solely for catalogue purposes are not Goods offered for online sale within the meaning of these Terms and Conditions.
  9. Electronic Service – a service provided electronically by the Seller to the Customer through the Shop.
  10. Business Days – Monday to Friday, excluding statutory public holidays in Poland.

§ 3. Technical requirements

  1. To use the Shop, the Customer requires:
    1. a device with Internet access,
    2. an up-to-date web browser supporting cookies and JavaScript,
    3. an active e-mail address where the relevant functionality requires one.
  2. The Seller takes measures to ensure the proper operation of the Shop, but technical interruptions, errors or maintenance work may occur.
  3. The Customer must use the Shop in a manner that does not disrupt its operation. In particular, it is prohibited to submit unlawful content or take actions that may compromise the security of the Shop or other users.

§ 4. Services provided electronically

  1. Through the Shop, the Seller may provide Customers with the following Electronic Services:
    1. access to the Shop's range and catalogue content,
    2. the ability to place an order using the order form,
    3. operation of a Customer Account where this functionality is available,
    4. the ability to contact the Seller using contact forms where available,
    5. the ability to subscribe to the newsletter where this functionality is active.
  2. Electronic Services are provided free of charge unless expressly stated otherwise.
  3. A contract for an Electronic Service consisting of:
    1. operating a Customer Account is concluded for an indefinite period when the Account is successfully registered,
    2. enabling an order to be placed is concluded for a fixed period and ends when the order is placed or the order process is abandoned,
    3. providing the newsletter is concluded for an indefinite period and may be terminated by the Customer at any time.
  4. The Customer may terminate a contract for a continuous Electronic Service at any time, in particular by:
    1. deleting the Customer Account,
    2. contacting the Seller,
    3. using the unsubscribe link in the newsletter, in the case of the newsletter.
  5. Complaints concerning Electronic Services may be submitted using the Seller's contact details stated in these Terms and Conditions. A complaint should include at least the information needed to identify the Customer and a description of the issue.

§ 5. Information about Goods and placing orders

  1. Information about Goods displayed in the Shop, including descriptions, specifications, photographs and prices, constitutes an invitation to enter into a contract unless expressly stated otherwise.
  2. Orders may be placed in the Shop 24 hours a day, 7 days a week, subject to technical interruptions.
  3. To place an order, the Customer:
    1. selects the Goods and adds them to the shopping basket,
    2. proceeds to the order form,
    3. provides the required information,
    4. selects the delivery and payment methods,
    5. accepts the required declarations,
    6. confirms the order using a button clearly indicating that the order entails an obligation to pay.
  4. By placing an order, the Customer submits an offer to conclude a Sales Contract for the Goods included in the order.
  5. After the order is placed, the Seller sends confirmation of receipt of the order to the e-mail address provided by the Customer.
  6. The Sales Contract is concluded when the Seller sends the Customer confirmation that the order has been accepted for fulfilment.
  7. The Seller provides the Consumer with confirmation of the distance contract on a durable medium within a reasonable time after its conclusion and no later than when the Goods are delivered.

§ 6. Prices and payment methods

  1. Prices of Goods shown in the Shop are stated in Polish zloty (PLN) and include applicable taxes unless expressly stated otherwise.
  2. The total order price, including the price of the Goods, delivery costs and any other charges, is shown to the Customer before the order is placed.
  3. Where a price reduction is announced, the Seller displays alongside the current price the lowest price that applied during the 30 days before the reduction. Where the Goods have been offered for less than 30 days, the lowest price is calculated from the date on which their sale began until the date on which the reduction was introduced.
  4. The payment methods currently available are shown to the Customer during the order process.
  5. The Seller provides, in particular, the following payment methods:
    1. online payment through Przelewy24, including methods made available by the operator such as BLIK, payment card or fast online bank transfer, subject to their current availability,
    2. traditional bank transfer to the Seller's bank account.
  6. The payment deadline depends on the selected payment method and the information provided to the Customer during the order process.

§ 7. Delivery

  1. Orders are fulfilled within Poland unless the Seller expressly offers delivery to another territory.
  2. The available delivery methods, expected fulfilment time and delivery cost are shown to the Customer before the order is placed.
  3. Unless otherwise stated for the relevant Goods or offer, the Goods will be delivered without undue delay and no later than 30 days after the contract is concluded.
  4. The risk of accidental loss of or damage to the Goods passes to the Consumer when the Goods are delivered to the Consumer. Where the Consumer independently selects a carrier not offered by the Seller, the risk passes to the Consumer when the Goods are handed over to that carrier, in accordance with applicable law.
  5. Detailed delivery conditions may also be set out on a separate Shop information page concerning delivery.

§ 8. Right to withdraw from the contract

  1. A Consumer who has concluded a distance contract generally has the right to withdraw from it without giving a reason within 14 days.
  2. The withdrawal period begins:
    1. for a Sales Contract concerning Goods, when the Consumer or a third party designated by the Consumer, other than the carrier, takes possession of the Goods,
    2. in other cases, in accordance with applicable law.
  3. To meet the deadline, it is sufficient to send the withdrawal statement before the withdrawal period expires.
  4. The Consumer may use the model withdrawal form attached to these Terms and Conditions, but this is not compulsory. The statement may be made in any unambiguous form.
  5. Where the Consumer withdraws from the contract, the Seller reimburses all payments received from the Consumer, including the cost of delivering the Goods up to the cost of the least expensive standard delivery method offered by the Shop, without undue delay and no later than 14 days after receiving the withdrawal statement.
  6. The Seller may withhold reimbursement until the Goods have been returned or the Consumer supplies evidence that they have sent the Goods back, whichever occurs first.
  7. The Consumer must return the Goods without undue delay and no later than 14 days after withdrawing from the contract.
  8. The Consumer bears the direct cost of returning the Goods unless the Seller has expressly agreed to bear it or failed to inform the Consumer that the Consumer would have to bear that cost.
  9. The Consumer is liable for any reduction in the value of the Goods resulting from handling them beyond what is necessary to establish their nature, characteristics and functioning.
  10. The right to withdraw does not apply in the cases provided for by law, in particular to the contracts listed in Article 38 of the Polish Consumer Rights Act.

§ 9. Complaints concerning Goods

  1. The Seller is responsible to the Consumer for the conformity of the Goods with the contract in accordance with the Polish Consumer Rights Act.
  2. The Seller is responsible for a lack of conformity existing when the Goods are delivered and disclosed within two years of that time, unless the stated useful life of the Goods is longer.
  3. Where the Goods do not conform to the contract, the Consumer may request repair or replacement. The Seller may replace the Goods instead of repairing them, or repair them instead of replacing them, where the remedy selected by the Consumer is impossible or would impose disproportionate costs.
  4. Repair or replacement is carried out within a reasonable time after the Seller is informed of the lack of conformity, without significant inconvenience to the Consumer and at the Seller's expense. These costs include, in particular, postage, carriage, labour and materials. The Consumer makes the Goods available for repair or replacement, and the Seller collects them at its own expense.
  5. The Consumer may request a price reduction or withdraw from the contract where:
    1. the Seller has refused to bring the Goods into conformity with the contract,
    2. the Seller has failed to bring the Goods into conformity with the contract,
    3. the lack of conformity continues despite an attempt to remedy it,
    4. the lack of conformity is sufficiently serious to justify an immediate price reduction or withdrawal without first requesting repair or replacement,
    5. it is clear from the Seller's statement or the circumstances that the Seller will not bring the Goods into conformity within a reasonable time or without significant inconvenience to the Consumer.
  6. A complaint may be submitted:
    1. in writing to the Seller's postal address,
    2. electronically to [email protected].
  7. Where possible, the complaint should include:
    1. information identifying the Customer,
    2. a description of the lack of conformity,
    3. the date on which it was identified,
    4. the Customer's requested remedy.
  8. The Seller responds to a Consumer complaint within 14 days after receiving it. If the Seller does not respond within that period, the complaint is deemed to have been accepted.
  9. Where the Goods are covered by a guarantee, information about its existence and conditions is provided separately. The guarantee does not exclude, restrict or suspend the Consumer's rights arising from a lack of conformity of the Goods with the contract.

§ 10. Complaints concerning Electronic Services

  1. The Customer may submit complaints concerning the operation of the Shop or Electronic Services using the Seller's contact details.
  2. The complaint should include at least:
    1. information enabling the Customer to be identified,
    2. a description of the problem,
    3. the Customer's request.
  3. The Seller considers a complaint concerning Electronic Services and provides a response within 14 days after receiving it.

§ 11. Customer Account

  1. Where the Shop allows a Customer Account to be created, registration requires the information indicated in the registration form.
  2. The Customer must provide true, current and complete information.
  3. The Customer must protect the Account access details and must not disclose them to unauthorised persons.
  4. The Seller may temporarily block an Account or restrict access to it where:
    1. these Terms and Conditions are breached,
    2. actions threaten the security of the Shop,
    3. false information is provided,
    4. the Account is used unlawfully.
  5. Unless immediate blocking is necessary for legal or security reasons, the Seller will first inform the Customer of the identified breach and allow an appropriate period for it to be remedied.
  6. The Customer will be informed of the Account block and the reason for it at the e-mail address associated with the Account, unless providing that information is prohibited by law.
  7. The Customer may request deletion of the Account at any time.

§ 12. Personal data and cookies

  1. Customers' personal data is processed in accordance with applicable law and the principles described in the Privacy Policy.
  2. The rules governing cookies and similar technologies are set out in the Cookie Policy.

§ 13. Firearms and Goods subject to special sales conditions

  1. Firearms displayed in the Shop are presented solely for catalogue and information purposes. They cannot be added to the shopping basket, ordered or purchased through the Shop, and their display does not result in a distance contract being concluded.
  2. Firearms are sold exclusively in the Seller's physical shop after all applicable legal requirements have been met, including verification of the purchaser's identity and documents entitling the purchaser to acquire the relevant type of firearm.
  3. Catalogue information about firearms, including price and availability information, must be confirmed in the physical shop before a sales contract is concluded.
  4. Where other Goods offered in the Shop are subject to restrictions concerning their sale, delivery, collection, transport or use, the Seller may make fulfilment of the order conditional upon:
    1. compliance with additional statutory requirements,
    2. presentation of required documents, permits or declarations,
    3. confirmation of the Customer's age or other entitlement,
    4. use of a particular handover, collection or delivery method.
  5. Information about special sales conditions is provided in the description of the Goods, during the order process or individually before the order is accepted for fulfilment.
  6. Where the requirements of applicable law or the sales rules for particular Goods are not met, the Seller may refuse to fulfil the order or suspend fulfilment until the matter is clarified.

§ 14. Out-of-court dispute resolution

  1. After completing the complaint procedure, the Consumer may use out-of-court procedures for resolving complaints and pursuing claims.
  2. Information about entities authorised to conduct consumer alternative dispute resolution proceedings is available at polubowne.uokik.gov.pl and on the website of the Polish Office of Competition and Consumer Protection.
  3. Where a dispute is not resolved through the complaint procedure, the Seller provides the Consumer on a durable medium with information about the competent authorised entity and whether the Seller intends to participate in the out-of-court procedure.

§ 15. Final provisions

  1. These Terms and Conditions take effect on 6 April 2026.
  2. The Seller may amend these Terms and Conditions for valid reasons, in particular where:
    1. applicable law changes,
    2. payment or delivery methods change,
    3. Shop functionality changes,
    4. the scope of Electronic Services changes,
    5. the provisions of these Terms and Conditions need to be clarified.
  3. Contracts concluded before new Terms and Conditions take effect remain subject to the version in force when the contract was concluded.
  4. Amendments do not affect rights already acquired by Customers.
  5. Where amendments concern services provided on a continuous basis, registered Customers will be notified at the e-mail address associated with the Account sufficiently in advance of the amendments taking effect.
  6. A Customer who does not accept amendments concerning continuous services may cancel the relevant service or request deletion of the Account before the amendments take effect.
